How and when must my bond be refunded in NZ?

Under the Residential Tenancies Act 1986, your bond is held by Tenancy Services (not your landlord) and must be refunded when the tenancy ends.

The bond refund process:

  • When your tenancy ends, either party can apply for the bond to be paid out
  • If both landlord and tenant agree on the amount, it is refunded quickly (usually within 10 working days)
  • If there is a dispute, the Tenancy Tribunal resolves it
  • What landlords can deduct bond for:

    • Unpaid rent
    • Damage beyond fair wear and tear
    • Cleaning costs if the property wasn't left in reasonable condition
    What landlords CANNOT deduct for:
    • Fair wear and tear (normal use over time)
    • Pre-existing damage (documented at start of tenancy)
    • General depreciation
    If your landlord is delaying: If the landlord does not apply for the bond within a reasonable time after the tenancy ends, you can apply to Tenancy Services directly at tenancy.govt.nz or call 0800 836 262.

    Key rule: Bond cannot exceed 4 weeks' rent (s19 RTA).
